Ho Collections and
the Truth About Your Debt

Remember to always insist on handling the debt collecting companies
by letter. Don't give out any phone numbers. The problem is during the
first call they make, when your defences are down, they'll say they
are calling from the bank or credit card company and this will make
you feel inclined to cooperate. They seek your uncertainty and perplexity,
so they want as much confusion as they possibly can: here is where HO
Collections will have the best result. When they get hold of this information
they will use it to pester you and even to scare you. The law is there
to prevent this sort of thing from happening but the problem is that
most people just don't know what to do and it is clear that the debt
collecting firms will use it to their advantage. Bodies like the excellent
CCCS or the CAB (Citizen's Advice Bureau) are there to offer help but
often they are stretched to capacity so there are times when such help
is lacking in detail.
The law in the UK seems not to notice when this injustice occurs,
or so it appears. Many of the debt collection companies that trade in
the UK are owned by foreign investment companies knowing where to make
a fast buck. There are several laws in place regarding HO Collections,
but for some unknown reason the debt firms manage to operate by breaking
the rules whenever they think they can get away with it. They only stop
when they are censured by a body like the Financial Services Authority
or the oft. And even then the small punishment they are handed is such
a tiny fraction of their overall receipts that they don't really give
a damn, and they laugh at such punishments.
If you are having to deal with HO Collections you can draw comfort
that a lot of the things that they are using to harass you remain illegal
or have become so. These debt collecting companies or DCAs appear under
very little obligation to do anything about improving their conduct
until made to do so by some official institution or similar body.
Assuming that you are having to deal with HO Collections you'll be
aware of all the nasty tricks they use to get money out of you so that
they can profit from your misery. You may have already experienced bad
dealings with them. They may phone you up when they know it is inconvenient
or even embarrassing for you and on an unacceptably numerous number
of occasions. They may write official appearing nastily worded letters
or cards threatening that they will come round to collect the amount
in full or that they will take you to court for the full amount. Their
other tricks could include attempting a charging order on your home
or make you homeless.
So ask HO Collections
for a copy of the original contract when you took out your loan or credit
card.
Even better, start
an unenforceable
credit agreement application here. If you want to check, in addition,
missold PPI and recover all the credit card charges you've paid over
the last 6 years (plus 8% interest) it costs an upfront fee of only
£99 for a full audit to see what you're entitled to. Click
here for more.
To find out if you
qualify for an IVA or can benefit from a debt management programme,
try the IVA
Test. It's free to apply, and again you are protected by the consumer
laws regarding debt management at all stages. Click
here to go to the application form.
